Marketplace Terms

Terms for business membership and use of the Haulier Link road freight marketplace. These terms are intended for UK business users, not consumers.

Operator and scope

Haulier Link provides the online business marketplace referred to in these Terms as the “Platform”.

These Terms govern business access to the Platform. They do not themselves make Haulier Link a party to any contract for collection, carriage, handling or delivery of goods.

Business eligibility and authority

  • Accounts may only be used for business purposes by people authorised to bind or act for the organisation shown on the account.
  • Members must keep their identity, contact, Companies House, VAT, operator-licence, insurance and verification information accurate and current where applicable.
  • Approval or verification by Haulier Link is an access control, not a warranty that a member is suitable, solvent, insured, licensed or able to perform every job.
  • Each organisation is responsible for its staff, invited users, credentials and all activity carried out through its account.

Haulier Link is a marketplace, not the carrier

Haulier Link provides listing, matching, communication, audit and optional document tools. Unless expressly agreed in a separate signed document, Haulier Link does not act as carrier, freight forwarder, consignor, consignee, employer, insurer, payment agent or agent authorised to contract for either member.

Members make their own commercial, operational and credit decisions and should carry out any checks needed before contracting.

Advertising does not guarantee coverage

  • A published load is an invitation for eligible members to express interest. It is not a promise by Haulier Link that an offer will be received.
  • An Expression of Interest is not a booking and does not oblige the advertiser to award the load.
  • Until the advertiser awards and the selected carrier accepts, there is no confirmed carriage contract through the Platform.
  • The advertiser remains responsible for contingency arrangements, customer commitments and any decision to use another provider if a load is not covered.

Provisional award and direct contract formation

When an advertiser selects an Expression of Interest, Haulier Link creates a provisional award and removes the load from the live marketplace. The selected carrier may review the permanent job record and either accept it or, before collection, use the unable-to-cover process.

The parties intend their direct contract for the job to form when an authorised user of the selected carrier clicks Accept direct carriage contract. The Platform records the time, user, organisations, agreed price, job details and applicable Terms version.

The direct contract is between the posting organisation and carrying organisation only. Its job-specific terms include the accepted price, payment terms, collection and delivery information, vehicle/equipment requirements, instructions and other details stored in the awarded job record. Any separately agreed terms between the parties may also apply; the parties should resolve conflicts in writing.

Poster responsibilities

  • Provide complete, lawful and accurate freight, weight, dimensions, classification, value, handling, access, timing and contact information.
  • Disclose dangerous, regulated, temperature-controlled, high-value or otherwise specialist goods and all required equipment or qualifications.
  • Have authority to offer the load and make the goods available for lawful carriage.
  • Assess offers and the selected carrier’s suitability, licensing, insurance, capacity and compliance.
  • Pay the carrying organisation directly in accordance with the agreed job and applicable VAT rules.

Carrier responsibilities

  • Only express interest where the organisation reasonably expects to have suitable capacity, licences, insurance, drivers and vehicles.
  • Review all job details before accepting and promptly raise ambiguities with the advertiser.
  • Comply with road transport, operator licensing, drivers’ hours, vehicle safety, load security, dangerous-goods and other applicable laws.
  • Perform the accepted job with reasonable skill and care and keep operational statuses accurate.
  • Notify the advertiser promptly if unable to cover, delayed, damaged, refused or otherwise affected, and preserve appropriate evidence.

Charges, payment and tax

The advertiser and carrier settle freight charges, VAT, credit terms, deductions and disputes directly. Haulier Link does not receive or hold the freight payment unless a future service is introduced under separate terms.

Haulier Link may charge subscriptions or feature fees for Platform access. Access to paid features may be suspended or changed according to the applicable subscription terms, without deleting the underlying job audit record.

Cancellations and unable to cover

The current Platform flow permits a selected carrier to return a job before collection and preserves the event for audit. The parties remain responsible for any direct contractual consequences, wasted costs, cancellation charges or losses. Haulier Link does not decide these liabilities merely because it records the event.

Documents and proof of delivery

Job Documents and Proof of Delivery are optional secure file features. Members must upload only relevant, lawful files, minimise personal data, scan files for malicious content and retain any originals required by law or contract. Platform storage does not replace a member’s own records, backup, transport documentation or evidence obligations.

Restricted conduct and goods

Members must comply with the Acceptable Use Policy. Illegal goods, misleading listings, unsafe instructions, fraudulent conduct, sanctions evasion, unauthorised access, scraping and anti-competitive coordination are prohibited.

Availability, records and changes

The Platform may be unavailable for maintenance, security or events outside reasonable control. Members should not rely on it as their only operational record or contingency method. Haulier Link may correct data, preserve audit records, suspend accounts and change features where reasonably required for safety, law, security or service operation.

Liability

Nothing in these Terms is intended to exclude liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

Subject to that rule, liability arising from the Platform service is separate from liability arising under the direct carriage contract between the posting organisation and the carrying organisation. Each member remains responsible for its own commercial, operational and transport obligations.

Law, disputes and contact

Members should first raise job disputes directly with the other contracting organisation and preserve the Platform audit trail. Platform complaints may be raised through Haulier Link support.

These Terms and use of the Platform are governed by the law of England and Wales, subject to any mandatory law or transport convention that applies to a particular carriage contract.
